Privacy Policy

1. Introduction.

(a) Website Owner. Viridian Inc. d/b/a Viridian Inc. (“Viridian“) is the owner of this website (“Website”). This online privacy notice discloses Viridian information practices for this Website, including what type of personal identifiable information is requested in order to make a purchase, how the information is used, and with whom the information is shared.

(b) Website Visits. In general, you can visit on the Website without disclosing any personal information. Viridian keeps track of the domains from which people visit us and analyzes the data gathered from the Website visits for trends and statistics.

(c) Website Transactions. At times, Viridian will need personal information regarding a customer. For example, to process an order or provide a subscription, Viridian may need to know a customer’s name, mailing address, e-mail address and credit card details, as further described in Section 2. It is Viridian’s intent to inform you before Viridian collects personal information, such as the customer’s name and/or address on the Internet. If you tell us that you do not choose to have this information used as a basis for further contact with you, Viridian will respect your choice.

2. Personal Information That May Be Collected.

(a) Identifying Information. In order to make a purchase, Viridian will request a user to provide certain personal identifying information, which may include: legal name, postal address, e-mail address, log in identification, password, telephone number, method of payment, and, if applicable, credit card number. Viridian may request additional information necessary to establish and maintain customer’s account. Viridian, at customer’s sole discretion, may also collect health data information if customer provides such information to Viridian.

(b) Payment Information. Viridian may collect data necessary to process a customer’s payment if you choose to make purchases, such as your payment instrument number, and the security code associated with your payment instrument. All payment data is handled and stored by PayPal. You may find their privacy notice links in Section 5(c).

(c) Service Quality Monitoring. Some of the Website transactions may require a customer to telephone Viridian, or Viridian to call the customer. Viridian will not contact you by telephone without your prior consent, except to confirm an order placed online and/or to inform a customer of the status of such order. Customer should be aware that it is Viridian’s practice to monitor, and in some cases record, such calls for staff training or quality assurance purposes.

(d) Lost or Stolen Information. If a customer’s credit card and/or password is lost or stolen, the customer should promptly notify Viridian in order to enable Viridian to cancel the lost or stolen information and to update its records with a changed credit card and/or password.

(f) Information Automatically Collected. Viridian automatically collects certain information when you visit, use, or navigate the Website. This information does not reveal your specific identity (such as your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you used the Website, and other technical information. This information is primarily needed to maintain the security and operation of the Website, and for Viridian’s internal analytics and reporting purposes. This information may include, but is not limited to, log and usage data, device data, and location data.

3. Uses Made of the Information.

(a) Limited Uses Identified. Without your prior consent, and subject to Section 4 and 5 herein, Viridian will not use your personal identifiable information for any purpose other than that for which it is submitted. Viridian uses personal identifiable information to reply to inquiries, handle complaints, provide operational notices and in program record-keeping. Viridian also processes billing and business requests related to the Website participation.

(b) Marketing Uses. Unless you opt-out as herein provided, Viridian reserves the right to provide you with information about the Website, Viridian products and services, and related information in which you have indicated an interest.

(c) Stored Information Uses. Viridian stores and retains information. This information is used to compile a customer’s purchase history in order to: enable Viridian to recommend products, services, or special offers that would be of interest to a customer; to support customer interaction with the Website; to deliver customer purchases; contact customer again about other Viridian services and products; and more.

4. Disclosure of the Information.

(a) Within Corporate Organization. Viridian may share your personal information within the Viridian corporate organization, and may transfer the information to countries in the world where Viridian conducts business. Some countries may provide less legal protection for customer personal information. In such countries Viridian will still handle customer personal information in the manner described herein.

(b) Mergers and Acquisitions. Circumstances may arise where for business reasons, Viridian decides to sell, buy, merge or otherwise reorganize its businesses in the United States or some other country. Such a transaction may involve the disclosure of personal identifying information to prospective or actual purchasers, and/or receiving such information from sellers. It is Viridian’s practice to seek appropriate protection for information in these types of transactions.

(c) Agents. Viridian employs or engages other companies and individuals to perform business functions on behalf of Viridian. These persons are provided with personal identifying information required to perform their functions, but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments and providing customer services.

(d) Affiliated Businesses. Viridian works closely with affiliated businesses operating website stores, providing services or selling products on each other’s Websites. These businesses identify themselves to customers. Customer information related to a transaction with an affiliated business is shared with that affiliated business.

(e) Vendors, Consultants, and Third Parties. Viridian may share customer data with third-party vendors, service providers, contractors, or agents (cumulatively “Third Parties”) who perform services for Viridian or on Viridian’s behalf and require access to such information to do that work. Viridian has contracts in place with Third Parties, which are designed to help safeguard customer personal information. Third Parties cannot do anything with customer’s personal information unless Viridian has instructed Third Parties to do so. Third Parties will also not share your personal information with any organization apart from Viridian. Third Parties also commit to protect the data they hold on Viridian’s behalf and to retain it for the period Viridian instructs.

(f) Disclosure to Governmental Authorities. Under certain circumstances, personal information may be subject to disclosure pursuant to judicial or other government subpoenas, warrants or orders.

5. Third-Party Analytics and Interest-Based Advertising

(a) Third-Party Partners. Viridian partners with Third Parties to engage in analytics, auditing, research, and reporting on the Website. Third Parties may collect information regarding customer’s usage of the Website as described in the section above titled “Information that We Collect” and “Vendors, Consultants, and Third Parties.” In particular, Viridian uses Google Analytics and on the Website. Viridian also partners with Third Parties to provide advertising services that are targeted based on customer’s online activities across websites and devices over time (commonly referred to as “interest-based advertising”). Third Parties may collect information about customer activities on the Website on customer’s current device and combine it with information about customer’s activities on other websites and devices. Third Parties may collect such information using server logs, cookies, web beacons, tags, pixels, cross-device linking, and similar technologies. For example, advertising Third Parties Viridian partners with may use the fact that customer visited our Websites to target advertising to said customer on non-Viridian websites on customer’s current device or on other devices customer uses.

(b) Opt Out. You can opt out of interest-based advertising in web browsers by visiting optout.aboutads.info and optout.networkadvertising.org. Please note that the opt-outs will apply only to the specific browser from which you opt out, and therefore you will need to opt out separately on all of your browsers and devices. If you delete or reset your cookies, change browsers (including upgrading certain browsers), or use a different device, you will need to opt out again.

(c) Privacy Policy of Third Parties. We currently use the services of the following third-party vendors, who may collect your information. You can click on the hyperlinks below to view their privacy policies, which may be updated from time to time. Viridian will do its reasonable best to update the links when the third-party vendor updates their link.

6. Use of Computer Tracking Technologies.

(a) Use of Cookies. Viridian and/or its Third Parties, collects non-identifiable and personal information through the use of various technologies, including “cookies.” A cookie is an alphanumeric identifier that a website can transfer to customer’s hard drive through customer’s browser. The cookie is then stored on customer’s computer as an anonymous tag that identifies the customer’s computer, but not the customer. Cookies may be sent by Viridian or its third party vendors. Customer can set its browser to notify customer before a cookie is received, giving an opportunity to decide whether to accept the cookie. Customer may also set their browser to turn off cookies; however, some websites may not then work properly.

(b) Use of Web Beacon Technologies. Viridian may also use Web beacon or other technologies to better tailor the Website to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Website, a non-identifiable notice of that visit is generated which may be processed by Viridian or by its suppliers. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer’s visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.

(c) Collection of Non-Identifiable Information. Viridian may collect non-identifiable information from user visits to the Website in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on the Website; Website and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” Viridian or its contractors may use this data to analyze trends and statistics.

(d) Collection of Personal Information. Viridian collects personal identifying information from customer during a transaction. Viridian may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help Viridian understand trends and patterns. This information is not reviewed at an individual level.

7. Information Security.

(a) Commitment to Online Security. Viridian employs physical, electronic and managerial procedures to safeguard the security and integrity of personal information. Billing and payment data is encrypted whenever transmitted or received online. Personal information is accessible only by staff designated to handle online requests or complaints.

(b) No Liability for Acts of Third Parties. Viridian will exercise all reasonable efforts to safeguard the confidentiality of customer personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, Viridian shall not be liable for unauthorized disclosure of personal information due to no fault of Viridian including, but not limited to, errors in transmission and unauthorized acts of Viridian’s staff and/or Third Parties.

8. Privacy Policy Changes and Rights.

(a) Changes to Privacy Policy. Viridian may update this Privacy Policy from time to time. The updated version will be indicated by an updated “Revised” date at the top of this Privacy Policy. If Viridian makes material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. Viridian encourages you to review this privacy notice frequently to be informed of how we are protecting your information.

(b) Your Rights. You have rights under data protection laws. However, these rights are not absolute, and Viridian may decline your request for such right as permitted by law. These rights include:

· The right to know if Viridian is processing your personal data;

· The right to access your personal data;

· The right to correct inaccuracies in your personal data;

· The right to request the deletion of your personal data;

· The right to obtain a copy of the personal data you previously shared with Viridian;

· The right to non-discrimination for exercising your rights; and

· The right to opt out of the processing of your personal data if it is used for targeted advertising (or sharing as defined under California’s privacy law), the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects (“profiling”).

Some states also provide you with the following rights:

· The right to obtain a complete list of the Third Parties to which we have disclosed personal data and the categories thereof (as permitted by applicable law, including California’s, Delaware’s, and Oregon’s privacy law);

· The right to limit use and disclosure of sensitive personal data (as permitted by applicable law, including California’s privacy law); and

· The right to opt out of the collection of sensitive data and personal data collected through the operation of a voice or facial recognition feature (as permitted by applicable law, including Florida’s privacy law).

(c) Exercise of Rights. To exercise these rights, you can contact us by calling toll-free at 1-844-506-8567. Additionally, Viridian will honor your opt-out preferences if you enact the Global Privacy Control(GPC) opt-out signal on your browser. You may also review your rights under your state’s data protection laws to determine if any other rights are available to you, to which Viridian will comply with such laws.

(b) Terms and Conditions. By entering into a purchase order and/or to subscribing to Viridian’s services, you hereby deemed acceptance of Viridian practices described in this policy statement. Any dispute over privacy between customer and Viridian is subject to the provisions of this notice and to Viridian‘s Terms and Conditions.
